The Trump administration announced Friday that it will no longer defend a decades-old grant program that handed out taxpayer dollars exclusively to colleges with large Hispanic student populations.

The program, first created in 1998, allowed schools with at least 25% Hispanic enrollment to receive hundreds of millions in federal grants. Tennessee and the conservative legal group Students for Fair Admissions—famous for winning the Supreme Court battle against affirmative action at Harvard—challenged the scheme in court.
Tennessee argued its universities serve Hispanic students just like everyone else, yet they are excluded because they don’t meet Washington’s “arbitrary racial threshold.” That means hardworking taxpayers were forced to subsidize colleges that received funding simply for checking a race-based box.
DOJ: Taxpayer Money Should Not Be Based on Race
In a letter to Republican House Speaker Mike Johnson, Solicitor General John Sauer confirmed the DOJ “has decided not to defend” the program. He cited the Supreme Court’s 2023 ruling banning racial balancing in college admissions, saying such practices are “patently unconstitutional.”
This ruling is another victory for fairness, merit, and equal treatment under the law.
